Spanish Law 19/2013, of 9 December, on transparency, access to public information and good governance is intended to increase and reinforce transparency of the public activity as a mechanism to facilitate the control of public action.

The Spanish National Securities Market Commission, in the exercise of its functions and activities, addresses the transparency regime from two perspectives: 

  • The active advertising of relevant information to ensure the transparency of its public activity.

  • Citizens’ right of access to public information. This “right of access” section offers relevant information on how to request information from the Spanish National Securities Market Commission.

INSTRUCTIONS TO REQUEST THE RIGHT OF ACCESS

Filing a request with a digital certificate

If you wish to file your request electronically you must complete the following form  and sign it electronically. For its submission, you must access the “open area” enabled on the CNMV´s  Virtual Office.

You must identify yourself using your digital certificate or DNI (Spanish national identity card) with a recognised electronic signature, select the last procedure available in the “open area”: “Any document, request or communication to be addressed to the CNMV” on the form to be filed, and select the department to which the procedure is addressed: General Secretariat. You must upload the form of the request indicated in the paragraph above as an attached document.

Technical requirements

A digital certificate of a natural person, legal person or a legal representative issued by any certification service provider which has submitted the mandatory communication to the Ministry of Economic Affairs and Digital Transformation, pursuant to Article 17 of  Spanish Law 6/2020, of 11 of november, regulating certain aspects of trusted electronic services, as well as using the e-DNI (electronic Spanish National Identity Card) issued by the Directorate-General of the Police.

Filing the request without a digital certificate

You can also file your request electronically without a certificate by completing this form.

Upon completion, you can submit it in person at the general register of the Spanish National Securities Market Commission at its headquarters in Madrid or Barcelona or at Public Administration Document Registration Units.
